Now Get Compensated For Your Delayed Flights

According to the EC Regulation 261/2004, every individual has rights to claim when their flight delays. The European Union Law (EC) laid rules concerning compensation as well as assistance to its passengers. The flight delays compensation rule applies only within the EU, with their airlines and from EU to another country.

Since there are so many rules, some clarification as to how to be compensated for delayed flight is expected.  Generally, you get monetary compensation when your flight delays. However, when some natural circumstances occur (e.g.: storm), the airlines are not responsible to provide you compensation according to eu delayed flight compensation. If such a thing happens, the airlines should reveal if it is strike, bad weather or technical problem or this may make the airlines to provide flight delay compensation.

A strike is considered as the act of God and it does not require any compensation. Bad weather such as storm and ice rain is also uncontrollable factors. Technical issues are also viewed as an act of God if it was impossible for the airline to anticipate the technical problem.

But if the other flights are able to reach their destination during a strike and if technical problems can be avoided by either sheltering the plane or appropriate cleaning of runaway and keeping some spare parts for emergency, then the airline have to make airline delay compensation.

However, the airlines are obliged to offer you accommodation, making calls or refreshment. You are also entitled to some additional rights that are noted in the Montreal Convention. Isn’t it interesting to know that you can even get compensation-delayed flights?

How to claim flight delay compensation

The EC Regulation 261/2004 is a European Law that demands flight delay compensation for the entire airline used in EU airspace. The question that people have in their mind is how to claim flight delay compensation. It is not compulsory that you have to be a citizen of EU to claim eu flight delay compensation.

This means that you can claim airline compensation for delays if your flight arrives in EU Airline, is departing from any airline in the European Union, or is from Switzerland, Iceland or Norway.

In case, you have reserved flight for the whole journey by buying a single ticket, the time at which it reaches the final destination is used to determine the eu flight delay compensation.  All flights are considered a single flight if they are booked by same reference. No one has rights to claim airline delay compensation if you have booked different legs as a single flight by yourself.

On 7 May,2013, the Federal Court declared that the passengers of delayed flights are entitled to flight delay compensation as per article 3 of EU Regulation 261/2004.  It also stated that delay should be such that the passenger misses his next flight.
